Tree Surgeons Aldgate – Service Terms and Conditions

Tree surgeon team carrying out planned pruning workThese Terms and Conditions set out the basis on which tree surgery services are provided by Tree Surgeons Aldgate. They apply to all quotations, bookings, instructions, works, and related services carried out for domestic, commercial, and communal properties. By making a booking, accepting a quotation, or authorising work to begin, the customer agrees to these terms. For the avoidance of doubt, these terms are intended to create a clear and fair framework for the provision of tree surgery services, including pruning, reduction, crown work, dismantling, stump-related services, and associated site clearance.

In these terms, references to “we”, “us”, and “our” mean the service provider trading as Tree Surgeons Aldgate, and references to “you” and “your” mean the customer, client, property owner, or person authorised to instruct the work. Where the customer is acting on behalf of a landlord, managing agent, business, or other third party, the customer confirms that they have authority to accept these terms and to permit access to the relevant site. These terms should be read together with any written quotation, scope of work, or job confirmation issued for a particular project.

The services supplied are nature-led and site-specific, meaning the exact method, timing, staffing, machinery, and waste handling arrangements may vary depending on the condition of the trees, access restrictions, prevailing weather, and legal considerations. Tree surgeons in Aldgate may therefore need to adjust their approach to comply with safety requirements, arboricultural best practice, and applicable law. Any such reasonable changes do not, by themselves, amount to a breach of contract.

1. Booking Process

Bookings may be made following an initial enquiry and, where appropriate, a survey or assessment of the site. A quotation may be based on information supplied by you, including photographs, descriptions, measurements, previous reports, or an on-site inspection. Unless expressly stated otherwise, quotations are invitations to proceed and remain valid for the period stated in the quotation document, or if no period is stated, for a reasonable time only. Acceptance of a quotation may be made in writing, by electronic message, by signed approval, or by confirming that work may commence.

Booking and quotation process for arborist servicesA booking is not confirmed until we have accepted the instruction and, where relevant, received any required deposit or advance payment. We may request access details, parking arrangements, service lane information, tree ownership evidence, or permission from a managing party before confirming the date. If the proposed works require approvals, notices, or checks under tree preservation controls, conservation restrictions, lease conditions, or third-party permissions, you are responsible for ensuring that those matters are obtained unless we have agreed in writing to assist. Arborist services will only proceed when the site can be accessed safely and lawfully.

2. Scope of Services and Site Conditions

The scope of work will be limited to the tasks described in the quotation or confirmation. Any additional work requested on the day, or any work becoming necessary because of hidden defects, unstable limbs, obstructed access, or unforeseen hazards, may be treated as an extra chargeable service. We reserve the right to suspend or alter works if conditions differ materially from those represented before booking. Examples include concealed decay, nesting wildlife constraints, severe lean, underground services, unsafe structures, or impeded access for equipment and waste removal.

Safety-focused tree surgery work on a residential siteYou acknowledge that tree surgery involves inherent risks, including but not limited to falling branches, sawdust, flying debris, noise, vibration, stump movement, and temporary disruption to surrounding areas. We will take reasonable precautions, but you are responsible for ensuring that children, pets, residents, employees, visitors, vehicles, and vulnerable items are kept clear of work zones where instructed. If a job must be delayed because of unsafe conditions, unsuitable weather, or incomplete site readiness, we may rebook the service and apply any reasonable costs associated with mobilisation or standby time.

3. Payments

Unless otherwise agreed in writing, invoices are payable in accordance with the payment terms stated on the quotation or invoice. We may require a deposit, part payment, or payment on completion depending on the size, risk, materials, and scheduling of the work. For larger commercial jobs, staged payments may apply. Payment methods accepted will be identified at the time of booking or invoicing. All sums must be paid in full without set-off, withholding, deduction, or counterclaim unless required by law.

If payment is not received by the due date, we may charge statutory interest and reasonable recovery costs to the extent permitted by the Late Payment of Commercial Debts legislation or, for consumer transactions, other applicable law. Ownership of any removed timber, logs, chips, or saleable by-products will remain with us until all sums due are paid in full, unless we have agreed otherwise. Where payment is due on completion, failure to pay may result in further work being withheld and access arrangements being suspended for any related follow-on services.

Quoted prices are normally based on the information available at the time of estimate. If the actual conditions, access, disposal requirements, timber volume, height, rigging needs, or time on site differ materially from the original assumptions, the price may be adjusted fairly to reflect the additional work. Any significant variation will normally be explained before proceeding where time and circumstances allow. Tree surgeons may also pass on charges for permits, parking, skips, specialist disposal, or other third-party costs where those costs are necessary for the lawful completion of the service.

4. Cancellations, Rescheduling, and Delays

You may cancel or request a change to a booking by giving us notice as early as possible. For consumer customers, any cancellation rights that apply under the Consumer Contracts Regulations or other relevant law will be honoured where they apply to the specific transaction. However, where you request that work begins within the statutory cancellation period, you may be asked to confirm consent to early performance and acknowledge that charges may apply for work already carried out, materials purchased, or time reserved for your job.

If you cancel at short notice, fail to provide access, or are not ready for the service at the agreed time, we may charge a reasonable cancellation fee to cover planning, labour allocation, and travel where permitted by law and where the loss is not avoidable. Weather, traffic, equipment breakdown, emergency call-outs, staff illness, or safety-related issues may also require rescheduling. We will use reasonable efforts to notify you and propose a new date, but we are not liable for delay caused by matters outside our control, provided we act reasonably and in good faith.

If access to the site is denied or conditions prevent work from starting, any wasted attendance or additional waiting time may be chargeable. Likewise, if a customer asks us to stop works after commencement, we may invoice for labour, materials, waste handling, and completed elements of the task. In every case, our aim is to be proportionate and transparent, while ensuring that tree surgery services already delivered are fairly paid for.

5. Liability and Insurance

We will carry out services with reasonable care and skill and in accordance with applicable professional standards. Our liability for loss or damage arising from our negligence, breach of contract, or failure to perform the services will be limited to the extent permitted by law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Where you are a consumer, your statutory rights are not affected.

We are not responsible for pre-existing defects, hidden decay, structural weakness, root instability, underground obstructions, or damage arising from the natural condition of the tree or surrounding property, unless directly caused by our negligence. Trees are living organisms and may respond unpredictably to pruning, reduction, or removal; therefore, outcomes such as regrowth patterns, leaf density, seasonal appearance, or future structural behaviour cannot be guaranteed. We do not accept responsibility for indirect or consequential losses, including loss of profit, loss of amenity, or business interruption, except where required by law.

Waste management and site clearance after tree removalYou must inform us of any known hazards before work starts, including electric lines, fragile roofing, hidden services, contaminated land, infestations, protected species concerns, or unstable ground. You should also keep valuables, ornaments, and movable items clear from the working area. If you ask us to work near structures, glass, fences, utilities, or ornamental planting, you accept that some degree of incidental disturbance may be unavoidable. We will take reasonable care, but arboriculture services often involve access limitations that make complete avoidance of minor scuffs, debris, or temporary disruption impracticable.

6. Waste Regulations and Site Clearance

All green waste, timber arisings, stump material, brushwood, sawdust, and associated refuse produced by our work will be managed in accordance with applicable waste regulations, environmental legislation, and duty of care requirements. Where we remove waste from site, we will do so using appropriate carriers and disposal routes. Waste transfer notes or other records may be retained where required by law or operational practice. You agree not to treat waste as abandoned or to dispose of it independently unless that is specifically agreed in writing.

Unless stated otherwise in the quotation, waste removal is included only to the extent described in the scope of work. Timber may be cut into manageable lengths, chipped, stacked, or removed depending on the arrangement agreed with you and the nature of the job. If you ask to retain logs, woodchip, or other by-products, you are responsible for safe storage and onward use. We may decline to leave certain materials where doing so would create a nuisance, safety risk, or breach environmental obligations. Tree surgeons in Aldgate may also have to segregate waste where different disposal streams apply.

Any contaminated, non-organic, or unusual waste discovered during the works may be treated separately and charged as an additional service if lawful and practical to remove. We will not knowingly breach waste legislation, fly-tip, or dispose of regulated material incorrectly. If the site contains items that are not part of ordinary tree work waste, such as building rubble, fencing, or hazardous materials, you must notify us before booking or as soon as they are discovered so that the correct handling can be arranged.

7. Customer Responsibilities

You are responsible for ensuring that the site is accessible and reasonably prepared for the work. This includes providing accurate information about the trees, confirming ownership or authority to instruct, securing pets and children, and moving vehicles or obstacles if requested. You must also ensure that any necessary permissions, notices, or approvals are in place unless we have agreed to arrange them. If inaccurate information is provided and this results in extra time, risk, or cost, we may charge accordingly.

Where our staff are required to enter land, courtyards, driveways, communal gardens, or business premises, you should ensure that access routes are reasonably clear and that any codes, keys, or instructions are supplied in advance. You are also responsible for telling us about any fragile surfaces, underground services, irrigation systems, or hidden fixtures that may be affected by the works. If we are asked to coordinate with contractors, managing agents, tenants, or neighbours, you remain responsible for ensuring that communications are accurate and timely.

Professional tree care service terms and conditions documentIf you request emergency attendance or urgent tree surgery, you acknowledge that the price, staffing, and method may differ from standard planned work. Emergency tasks may require immediate risk control before a fuller assessment can be completed. In such cases, we will act reasonably to make the area safe, but you accept that urgent works may be limited by conditions, available equipment, and legal duties. Any follow-on work will be separately scoped and priced.

8. Changes to the Service and Subcontracting

We may make reasonable changes to the team, equipment, sequencing, or method of work where this improves safety, efficiency, or compliance. We may also use qualified subcontractors or specialists to perform part of the service, provided they are suitably competent and the overall standard remains consistent with these terms. Any material change to the scope will be communicated where practical before the work is carried out.

Where a customer requests a variation to the original instruction, any revised quotation may supersede the earlier estimate to the extent of the change. This may include alterations to tree height, access method, timber retention, stump finishing, lifting arrangements, or waste removal. A variation may also arise if the condition of the tree or site becomes different from that initially assessed. In all cases, we will aim to keep the customer informed so that the work can continue on a fair and transparent basis.

9. Complaints and Disputes

If you believe any aspect of the service does not meet the agreed standard, you should notify us as soon as reasonably possible and provide enough detail for the issue to be reviewed. We may inspect the work, request photographs, or ask for access to the site if further assessment is required. Any complaint will be handled in a proportionate manner and in line with applicable consumer and commercial law. This does not limit any statutory rights you may have.

Both parties agree to act reasonably and attempt to resolve disputes without unnecessary delay or escalation. Nothing in these terms prevents either party from seeking legal advice or pursuing formal remedies where appropriate. However, we encourage prompt communication where any concern arises, particularly because tree works can be affected by seasonal growth, weather patterns, and site-specific conditions that may change quickly after completion.

10. Governing Law

These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any rights that consumers may have under applicable mandatory law. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

By booking or accepting services from Tree Surgeons Aldgate, you confirm that you have read, understood, and agreed to these terms. They are designed to provide a balanced agreement covering booking, payment, cancellation, liability, waste management, and legal compliance. Our goal is to deliver professional tree surgeon services with clarity, fairness, and respect for both safety and the environment.
